1. About Our Service

Evershine Diagnostics is an aggregator/facilitator platform that connects users, clinics, and partner diagnostic laboratories. We do not operate any laboratory and we do not perform tests ourselves.

Our services include:

• User profile creation and diagnostic test ordering.
• Scheduling phlebotomy / home sample collection.
• Transporting samples to partner laboratories.
• Delivering reports generated by partner laboratories to users.

2. Nature of Medical Reports

• All diagnostic tests are performed exclusively by our partner laboratories.
• Evershine Diagnostics does not guarantee, validate, or control the accuracy, quality, or timing of test reports.
• Interpretation of test reports must be done by a qualified medical professional.
• Minor differences between laboratory reports are common and are not the responsibility of Evershine Diagnostics.

3. Limited Liability

To the fullest extent permitted by applicable law:

• Evershine Diagnostics is not liable for errors, delays, or inaccuracies in laboratory test results.
• We are not liable for delays caused by partner laboratories, logistics, traffic, weather, or technical disruptions.
• We are not liable for issues arising from sample collection performed by clinics or clinic staff, including rejected samples due to clotting, insufficient volume, improper fasting, or incorrect storage.

Our responsibility ends once the sample is handed over to the partner laboratory. In the event of a dispute, Evershine Diagnostics' maximum liability is limited to the amount paid for the specific test order.

4. Sample Collection

• Samples may be collected by our trained phlebotomists or by clinic / doctor staff (where clinics collect samples themselves).
• When sample collection is performed by a clinic or doctor, Evershine Diagnostics is not responsible for sample quality, handling, improper storage, incorrect labeling, or any reporting errors caused by improper collection.

5. Use of Personal Information & Data Protection

We collect personal information necessary to provide our services, including:

• Name, age, sex/gender
• Address, phone number, email
• Health details relevant for diagnostic testing

All personal data is stored securely and encrypted using industry-standard measures. We do not sell, rent, or trade your personal information. Information is shared only with:

• Partner laboratories (for test processing)
• Phlebotomists (limited details needed for collection)
• Clinics/doctors (when booking is via a clinic)

By submitting your information you confirm that the details provided are accurate and truthful. Evershine Diagnostics is not responsible for issues arising from incorrect or false information provided by a user. You may request correction or deletion of your data as permitted by law.

6. Partner Laboratories

All tests are conducted by independent, certified third-party laboratories. These partner laboratories are solely responsible for sample processing, accuracy of results, and report generation. Any complaint about report content will be forwarded to the corresponding laboratory for investigation.

7. User Responsibilities

By using the platform you agree to:

• Provide accurate details for yourself and any family members for whom you create profiles.
• Be available at the scheduled time for sample collection.
• Follow pre-test instructions such as fasting, when applicable.
• Consult qualified medical professionals for diagnosis and treatment.
• Not misuse the platform or attempt fraudulent bookings.

8. Payment, Refund & Cancellation Policy

• Payment is required at the time of booking unless otherwise specified.
• Refunds are issued only if sample collection has not taken place, or the test cannot be processed by the laboratory.
• Refunds are not provided for rejected samples, incorrect information provided by the user, or lab delays beyond our control.
• Refund processing may take 7–15 working days.

9. Privacy & Security

• All user data is encrypted and protected by secure access controls.
• Only authorized personnel have restricted access to data.
• Users are responsible for safeguarding their login credentials.

10. No Medical Advice

Evershine Diagnostics is not a clinic, hospital, or medical provider. We do not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions.

11. Service Availability

We may update, modify, or temporarily suspend services for maintenance or operational reasons. We are not responsible for network outages, downtime, or technical interruptions.

12. Indemnity

You agree to indemnify and hold harmless Evershine Diagnostics, its staff, partners, phlebotomists, and affiliates from any claims, damages, or losses arising from misuse of the service, incorrect information provided by you, or issues caused by partner labs or clinics.

13. Governing Law

These Terms & Conditions are governed by the laws of India. Any disputes shall be resolved in the courts of [Your City/State].

14. Acceptance

By using our app, booking a test, or submitting personal information you confirm that you have read and agree to these Terms & Conditions, and that you understand the scope of our services and your responsibilities.
